CIRCULAR DATED 26TH OCTOBER 2016

REVISION OF MINIMUM PAY AND FITMENT FORMULA
2ND MEETING OF THE GROUP OF SENIOR OFFICERS WITH JCM (NC) STAFF SIDE

DISAPPOINTING

2nd Meetings of the Group of Senior Officers (Constituted as per the assurance given by Group of Minister to NJCA) to discuss the grievances arising out of recommendations related to 7th Central Pay Commission, was held with JCM (NC) staff side on 24.10.2016 at 4 PM. The staff side explained in detail the justification for modification in the minimum pay and fitment formula, which was already explained in the memorandum submitted to Cabinet Secretary on 10th December 2015 and also in the presentation made before Joint Secretary Implementation Cell and Empowered Committee of Secretaries headed by Cabinet Secretary.

From the response of the Senior Officers, it is not clear whether they are mandated to submit a proposal on increasing the Minimum Pay and Fitment formula to Government, as assured by the Group of Ministers on 30th June 2016. Even though, the time frame of four months is almost over, the urgency and seriousness was lacking on the part of the Group of officers. It seems that that Government is adopting a delaying tactics or to deny the assured increase. Perhaps, they may recommend an increase in minimum pay and fitment formula at a later date, but it is quite uncertain.

Confederation National Secretariat after reviewing these developments has decided to intensify the campaign and agitational programmes demanding the Government to honour its assurance given to NJCA leadership and also to settle the 20 point charter of demands. Make the 7th November 2016 mass dharna programme a grand success. Ensure maximum participation of employees in the 15th December 2016 massive Parliament March. Get ready for strike.

ALLOWANCE COMMITTEE MEETING ON DOP&T SPECIFIC ALLOWANCES

Meeting of the Allowance Committee to discuss the DOP&T Specific allowances was held on 25.10.2016. Secretary, Department of Personnel Chaired the meeting. Important allowances like Children Education Allowance, Night Duty Allowance, Overtime Allowance, Cash Handling Allowance, Dress Allowance, Nursing Allowance, Patient Care Allowance, Family planning Allowance, Risk Allowance etc. are discussed. The Secretary, Department of Personnel gave a patient hearing and interacted with staff side on certain points. No commitment on any allowance was given.

JCM NATIONAL COUNCIL – STANDING COMMITTEE MEETING

The JCM (NC) Standing Committee meeting under the Chairmanship of Secretary, Department of Personnel was held on 25.10.2016. All agenda items were discussed. Some of the items are – JCM functioning, Compassionate appointments, amendment to the definition of anomaly, Changing MACP conditions, Ex-Servicemen pay fixation, Pay fixation option on promotion after the date of notification of CCS (RP) Rules 2016, GDS bonus enhancement to 7000/-, casual labour regularization and bonus enhancement, filling up of vacancies, upgradation of LDCs to UDCs, one time relaxation of LTC-80 availed by air by purchasing tickets from other than authorized agents, Restoration of Festival Advance, Natural Calamity Advance and Advance of leave salary, grant of entry pay recommended by 6th CPC to the promotes, reimbursement of actual medical expenditure incurred by the employees in a recognised hospital etc. 

Secretary, Department of Personnel gave a patient hearing and clarified certain points. No final decision was taken on any of the agenda items. Gist published below. Minutes will be published later. It was informed that based on the discussion, each item will be examined further and decision will be taken.

AUTONOMOUS BODIES – EXTENSION OF 7TH CPC REVISED PAY STRUCTURE AND PENSIONARY BENEFITS

The issue was raised in the JCM Standing Committee meeting held on 25.10.2016 by the staff side. The official side informed that an overall review regarding the performance and financial viability etc. of each Autonomous body is being carried out by the Government. Only after completing the process decision regarding extension of 7th CPC revised pay structure and pensionary benefits, Bonus etc. will be taken. Extension of the benefits depends upon the policy decision of the Government. Hence the official side has not told any time frame for final decisionIt is likely to be delayed

Confederation has already included the demands of the employees of the autonomous bodies in its 20 point charter of demands. All Unions/Associations/Federation and employees of all autonomous bodies are requested to understand the gravity of the situation and make the 7th November 2016 mass dharna programme and 15th December 2016 Parliament March a grand success. Join the Parliament March with your flags, banners and placard with demands. Let the Government understand the discontentment and protest of employees and pensioners of Autonomous bodies. There is no short-cut to get our justified demand accepted by the Government.

GDS BONUS ENHANCEMENT TO 7000

This issue was discussed in the JCM Standing Committee meeting as a notified agenda. The official side informed that the file is still under process in the Finance Ministry and a decision is yet to be taken. Once the approval of the Finance Ministry is given the proposal is to be submitted to Cabinet for approval.

All affiliates and C-O-Cs are once again requested to extend full support and solidarity to the proposed Postal Strike on 9th & 10th November 2016, demanding bonus calculation ceiling limit enhancement to 7000/- for GDS and immediate payment of revised wages to casual labourers from 01.01.2006. Conduct solidarity demonstration in front of important Postal/RMS office on 9th & 10th November 2016.

GIST OF THE JCM STANDING COMMITTEE MEETING HELD ON 25.11.2016

Meeting was held under the chairmanship of Secretary, Department of Personnel. Items discussed and outcome is given below.

1.        JCM FUNCTIONING

Decision: After discussion Secretary (P), assured that the JCM would be activated and steps may be taken to hold regular meetings of JCM at National and Departmental level.

2.        COMPASSIONATE APPOINTMENT:

Decision: The demand of the staff side to remove 5% ceiling would be considered after studying the various. Supreme Court Judgments and the decisions of previous National Council JCM meetings. 

3.        RESTORATION OF INTEREST FREE ADVANCES WITHDRAWN BY THE GOVERNMENT BASED ON 7TH CPC RECOMMENDATIONS

DecisionThe demand of the staff side to restore Festival advance, Natural Calamity advance and leave salary advance will be examined further.

4.        AMENDMENT TO THE DEFINITION OF THE TERM “ANOMALY”

Decision: The proposal given by the staff side would be considered is consultation with Department of Expenditure.

5.        FIXATION OF PAY OF RE-EMPLOYED EX-SERVICEMEN

Decision: - The anomalies in the fixation of pay of re-employed Ex-Servicemen is under consideration of DOP&T.

6.  OPTION FOR THOSE TO BE PROMOTED AFTER 25.07.2016, I.E. AFTER THE NOTIFICATION OF CS (REVISED PAY) RULES 2016.

Decision: - This issue would be considered by the Implementation Cell of 7th CPC.

7.        WITHDRAWL OF NEW CONDITIONS FOR THE GRANT OF MACP & GRANT OF MACP ON PROMOTIONAL HIERARCHY

Decision: The demand of the Staff Side for withdrawal of “Very Good” grading would be re-examined. Regarding justification of MACP on Promotional hierarchy all the points submitted alongwith the Note on agenda items by staff side was discussed in detail. The official side agreed to examine issue further based on the points raised by the staff side. 

8.       BONUS CEILING TO BE RAISED TO 7000 FOR GRAMIN DAK SEVAK EMPLOYEES OF POSTAL DEPARTMENT

Decision: - Revision of Bonus ceiling for GDS and Casual Labourers would be considered by Department of Expenditure.

9.        REGULARISATION OF CASUAL LABOURERS

Decision: The proposal of the staff side for regularization of all casual labourers would be considered after considering various Supreme Court judgements.

10.     FILLING UP OF EXISTING VACANT POSTS

Decision:  – Since there is no ban on recruitment, vacancies can be filled up. Instructions in this regard will be issued once again.

11.     UPGRADATION OF THE POSTS OF LOWER DIVISION CLERKS TO UPPER DIVISION CLERKS

Decision: The demand of the staff side would be considered in consultation with other Ministries.

12.   GRANT OF ONE TIME RELAXATION TO THE CENTRAL GOVERNMENT EMPLOYEES WHO HAVE AVAILED LTC-80 AND TRAVELLED BY AIR BY PURCHASING TICKETS FROM OTHER THAN AUTHORIZED AGENCIES 

Decision: - The proposal of Ministry of Defence in this regard is under examination of DOP&T

13.     GRANT OF ENTRY PAY RECOMMENDED BY 6TH CPC TO THE PROMOTEES UNDER THE PROVISION OF CCS (RP) RULES 2008.

Decision: -    The Judgment of Chennai CAT and Principal Bench New Delhi would be examined by DOP&T and Department of Expenditure.

14. REIMBURSEMENT OF ACTUAL MEDICAL EXPENDITURE INCURRED BY THE EMPLOYEES IN A RECOGNIZED HOSPITAL.

Decision: -    A separate meeting would be held by the Health Ministry with the staff side to discuss this demand.

Some more items related to Ministry of Defence was also discussed.

A 300 % Salary Hike Has Been Proposed For President Of India Pranab Mukherjee

In the past days, the Modi government saw a lot of commotion amid the unhappy central government employees with regard to the problems related to minimum wages. The knotty issue has since remained a pressing agenda for many, until today.

In a move that almost looks too good to be true, the Modi government has proposed an increase in the salary of President and the Vice President of India.

Right now, the President withdraws Rs 1.50 lakh per month, the Vice-President Rs 1.25 lakh and the Governor of a state Rs 1.10 lakh.

After the implementation of the 7th pay commission the Cabinet Secretary, who is the topmost bureaucrat in the country, gets Rs 2.5 lakh per month and a Secretary in the Union government draws Rs 2.25 lakh.

But now, the President’s salary will be 5 lakh and the Vice President’s Rs. 3.5 lakh. The spouses of the Presidents will be receiving Rs 30,000 as compensation.

According to sources, the union ministry has already prepared a cabinet note on the proposed salary and is about to present it to the finance committee for a final nod.

Ever since the 7th pay commission swooped in, the salary of the two highest employees of Indian Government looked like peanuts. It increased the pay of the cabinet secretary with more than Rs 1 lakh than that of the President.

The pay commission doesn’t declare or decide the salaries of the President or the Vice President and the prerogative to effect a change lies with Parliament and the government.


The last hike was given in the year 2010 when the salaries were increased by 300%.

The President’s wages was increased to Rs 1.50 lakh per month from Rs 50,000, the Vice-President's to Rs 1.25 lakh from Rs 40,000 and the Governor's salary o Rs 1.10 lakh from Rs 36,000.

Smt. Maneka Sanjay Gandhi expresses concern at the inadequate implementation of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 

WCD Ministry to set up Inter-Ministerial Committee and an e-platform for effective redressal of complaints of sexual harassment at workplace 
The Minister of Women and Child Development, Smt. Maneka Sanjay Gandhi held a review meeting on implementation of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 in New Delhi today. Officials from the WCD Ministry, DoPT, Ministry of Youth Affairs & Sports, Ministry of Home Affairs, Ministry of Railways and Department of Financial Services were present. Smt. Maneka Sanjay Gandhi expressed her concern that the complaints of sexual harassment are not being handled in a timely as well as sensitive manner. She also expressed her concern that harassment often continues over a period of time and it is only after it becomes unbearable that a woman comes out to complain. In such situations, it is the duty of Internal Complaints Committee to decide on the complaint in the shortest possible time. The Minister also pointed out that the transfer of the aggressor can never be a solution to such a complaint and there should be harsher punishments when the complaint is found to be true.

2. After extensive deliberations, the following decisions were taken:

(i) The Ministry of WCD will set up an inter-ministerial committee headed by a senior official of the WCD Ministry. This committee will review the progress of disposal of complaints of sexual harassment, get a standardized training module prepared in collaboration with ISTM, ensure that heads of Internal Complaints Committee of all ministries/departments are given training on how to handle the complaints.

(ii) The ministry will be establishing a secure electronic platform for any woman employee of the government to file a complaint under the Act directly to the Ministry of WCD. These complaints will be then taken up with the respective ministries/ departments. This will enable a monitorable and transparent system of grievance redressal under the Act.

(iii) All ministries/ departments will furnish a monthly report to WCD ministry on the number of complaints received, disposed, pending and action taken etc.

(iv) All ministries/ departments and attached offices will furnish the annual statistics of complaints received and disposed under the Act in their Annual Reports. It was also decided that the inter ministerial committee will create a panel of resource persons from which ICCs can take the external members. In another important decision taken at the meeting today, all the training programmes of all services will have a module on the Act and DoPT will issue necessary instructions for this.

(v) It was also decided that the respective cadre controlling authority will keep every complainant under observation for a period of five years so that she is not subjected to any further administrative harassment as a result of her having complained against a male superior.

(vi) It was agreed that the Act, the rights of a woman official and the responsibility of the ICC must be given adequate publicity through different methods including the websites of the ministries/ departments/ attached offices.

Documentary "The Red Box" is part of the line-up at the Delhi Shorts International Festival, which begins on November 6

Chemanna Petti (The Red Box), a short film based on a newspaper report, has been selected for this year’s Delhi Shorts International Film Festival. The fifth edition of the festival begins on November 6.

The 13.5-minute documentary by Pius Scaria Pottenkulam, looking at the changing face of the Indian postal system through the life of a lonely postal woman manning a one-of-a-kind post office in the country, is based on a report ‘mail @Vembanad PO’ that appeared in The Hindu on August 21, 2007. The report tells the story of Vembanad Kayal Post Office, Pin 688006, perhaps the only one that covers a lake, and the Extra Department (ED) clerk V.P. Seethamani, who dons many roles at this post office.

The documentary tells its story in three segments, one taking a nostalgic look at the old days when letters were part of a culture: the long wait for the letters informing of an employment offer and those from loved ones from far-off lands.

Enduring symbol

The Red Box is always a symbol of love, says the director. The second segment speaks of the history of communication and the postal system.


The final segment talks about the present situation, the fall of the good old post offices because of a decline in letter-writing and the arrival of countless modes of communication that have made institutions such as the Vembanad Kayal PO look like fossils. The segment pans through the life of Seethamani, who has been working as an ED clerk for 27 years.

From nearly 5,000 letters a day in its heyday, the traffic has come down to not more than 150 letters a day at the post office, most of them pensions, she says.

The film concludes with a long-cherished dream of Seethamani, who wants to “don a government uniform” before she retires.

Postal department has not lost its sheen, says MP

The passion for hobbies such as collection of stamps and coins must be developed from childhood, to gain knowledge on history, culture, mythology and other aspects, Kurnool MP Butta Renuka said on Wednesday.

The Postal Department has not lost its sheen and has a significant place despite widespread use of smartphones and information sharing technologies, the MP said after inaugurating the Philately Bureau at the head post office.

Ms. Renuka lauded Post Master General Sanjiv Ranjan for taking up multifarious activities to develop the department. She complimented the students on exhibiting a wide range of stamps and first-day covers.

SSY passbooks

The MP and PMG presented Sukanya Samruddhi Yojana passbooks to parents of girl children. The beneficiaries included 45-day-old M. Adwithi. Commendation certificates were issued to department employees for meritorious service. Mementos and certificates were presented to students who succeeded in essay writing, elocution, letter writing and other contests conducted during Philately Week.

Mr. Ranjan asserted that he would leave no stone unturned to serve the people of Rayalaseema.

The Philately Bureau in Kurnool was one of the best in India, he added.

He presented a memento to Pratap Reddy of Guntur who purchased philately stamps worth Rs.1 lakh.

Superintendent of Post Offices K.V. Subba Rao said the Philately Bureau was the first to be started in Rayalaseema. He spoke about the department’s progress since issue of the first postage stamp in 1854 and the first post-Independence era stamp in 1947.

Postcards were widely used during the freedom movement, said Hotels Association president K.C. Kalkura. Of the over 5,000 stamps released so far, Andhra Pradesh’s share was less than 200, he said. Stamps on several eminent personalities of Andhra Pradesh were not issued, he said.

Assistant Director of Posts Ghouse Azam, Post Master David, postal employees and students of Montessori and Sister Stanislas high schools participated.

Justice Reddy committee on OROP submits report 
The one-man judicial committee on One Rank One Pension (OROP) submitted its report to the Defence Minister Shri Manohar Parrikar, here today. The Central Government had appointed the committee under the Chairmanship of Justice L Narasimha Reddy, retired Chief Justice of Patna High Court to look into the anomalies, if any, arising out of implementation of OROP.

The judicial committee had held hearings at around 20 cities/towns across the country and interacted with cross sections of Ex-Servicemen as well as their associations. The committee also received 704 representations from individuals and various Ex-Servicemen associations and had held extensive interactions with all stakeholders before submitting its report.

            In this connection we would like to draw your kind attention towards the decision taken on this subject in the Department Council meeting of JCM and instructions were issued to all heads of Circles in this regard vide Directorate letter No. 16/56/2011-SR dated 8th July,2011 which were  again reiterated  vide No. 08/15/20111-SR dated 09.11.2012.

            Further  it is also  brought to your  kind notice that the  same  reply was  given  by Secretary Post to the Parliamentary Standing  Committee vide Directorate  No. 16/51/2011-SR dated 08/7/2011 through Lok Sabha Secretariat.

            But now all these orders are being defied by the Heads of Circles.

            We are not against the development of Department. But the employees should not be deprived from their legitimate rights of availing weekly off and religious and festival holidays.

            It is therefore requested to kindly cause suitable instructions in this regard and on the day of Deepawali officials should not be ordered to perform this duty.

            A positive  action is highly solicited .

Cabinet approves release of an installment of Dearness Allowance to Central Government employees and Dearness Relief to Pensioners due from 01.07.2016 
The Union Cabinet under the Chairmanship of Prime Minister Shri Narendra Modi has given its approval to release an instalment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to Pensioners w.e.f. 01.07.2016 representing an increase of 2% of the revised Basic Pay/Pension, to compensate for price rise. The increase is in accordance with the accepted formula, which is based on the recommendations of the 7th Central Pay Commission.


The combined impact on the exchequer on account of both Dearness Allowance and Dearness Relief would be Rs. 5622.10 crore per annum and in the Financial Year 2016-17 for the period of 8 months (i.e. from July 2016 to February 2017), it would be Rs.3748.06 crore. About 50.68 lakh Government employees and 54.24 lakh pensioners will be benefitted.
